At the May 17, 2019, meeting of the Texas State Board of Dental Examiners (Board), Board staff was directed to initiate possible rulemakings for the following topics. Board staff is soliciting input from interested stakeholders and members of the public on the following topics in lieu of holding an in-person stakeholder meeting.
The Board requests stakeholder input on the following topics related to possible rulemaking proceedings:
Regulation of Silver Diamine Fluoride, specifically comments in support or opposition of rulemaking restricting the application of Silver Diamine Fluoride. The Board has received a rulemaking request to permit only Dentists and Registered Dental Hygienists to apply Silver Diamine Fluoride.
The Reduction or Termination of Nitrous Oxide Administration by Auxiliaries, specifically clarification of whether or not Registered Dental Hygienists and RegisteredDental Assistants who hold appropriate Nitrous Oxide Monitoring authorization may: (1) terminate the administration of Nitrous Oxide Sedation; or (2) reduce the administered concentration of Nitrous Oxide Sedation.

This solicitation of informal comments does not serve as an official comment period or rulemaking as required by Texas law or Board rules. Consideration of any rulemaking topics will occur at a future meeting of the Board held pursuant to Texas Government Code Chapter 551 (Texas Open Meetings Act), and all Board rulemakings will be conducted pursuant to Texas Government Code Chapter 2001 (Texas Administrative Procedure Act).
